Nader Akrami (“Mr Akrami”) breached the terms of the government backed Bounce Back Loan (“BBL”) scheme by causing Moser & Solomons Limited (“M&SL”) to apply for 3 BBLs of £50,000 each, resulting in the company receiving £150,000 BBL monies when he knew, or ought to have known, that M&SL was not eligible for more than 1 BBL to a maximum of £50,000, in that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover for the calendar year 2019. The turnover figure was self-certified by the applicant. The BBL scheme eligibility criteria allowed for businesses to only receive BBL funds of £50,000 maximum, with the applicant declaring that the company was not in the process of applying for or had already received a BBL. • If a company was established after 01 January 2019, they were allowed to estimate the company turnover from the date the company started to trade. • M&SL was incorporated on 18 October 1967, with Mr Akrami being appointed sole director on 01 August 2011. • On 16 May 2020 Mr Akrami completed a BBL application on behalf of M&SL for £50,000 from Bank A. This was drawn down on 22 May 2020. • On 22 May 2020 Mr Akrami completed a BBL application on behalf of M&SL for £50,000 from Bank B. This was received on 27 May 2020. • On 31 May 2020 Mr Akrami completed a BBL application on behalf of M&SL for £50,000 from Bank C. This was received on 10 August 2020. • The BBL terms and conditions in respect of Bank B and Bank C required Mr Akrami to self-declare that he had not made any other application for a BBL for the company. • By signing the declarations, Mr Akrami gave false information and received £100,000 of BBL funds that M&SL was not entitled to. • M&SL was wound up by court order on 27 November 2024. • Following the winding up order, claims totalling £356,963.73 have been made against M&SL, including £52,366.37 claimed by Bank A, £45,243.65 claimed by Bank B and £36,959.28 from Bank C.
