In September 2020, Neil McCaslin (“Mr McCaslin”) caused Rubeum Auri Limited (“Rubeum”) to apply for a Bounce Back Loan (“BBL”) of £50,000 when it was not eligible to access the scheme, which resulted in Rubeum obtaining a BBL that it was not entitled to, in breach of the BBL terms and conditions. Furthermore, Mr McCaslin failed to ensure that the BBL funds were used for the economic benefit of Rubeum, in that; • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover. In order to be eligible for the scheme, borrowers had to declare that their business was trading as at 01 March 2020 and at the date of the BBL application. • RAL was incorporated on 18 March 2019. • A review of Rubeum’s bank account statements show no sign of the company having conducted any trade prior to the BBL application. • In September 2020, Mr McCaslin caused Rubeum to apply for a BBL when it was not eligible to access the scheme. • On 09 October 2020, Rubeum received BBL funds of £50,000 which were then transferred into its main bank account. • Between 12 October 2020 and 19 October 2020, Mr McCaslin transferred £49,884.34 of the BBL funds to a third-party company, and these payments were not for the economic benefit of Rubeum. • Total liabilities at liquidation amount to £128,481 of which £50,000 relates to the amount owed in respect of the BBL.
