On 06 November 2020 Nisheet Patel (“Mr Patel”) caused or allowed Mega 5 Limited (“Mega”) to make a Bounce Back Loan (“BBL”) application of £50,000 which he knew or ought to have known did not meet the terms of the scheme. A wrongful declaration was made by overstating Mega’s turnover, as a result Mega has received BBL funds of £50,000 that it was not entitled to. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started. • Mega was incorporated on 13 February 2014. • Financial Accounts for year-ended 28 February 2019 were filed at Companies House on 28 November 2019, had a turnover was £NIL. • Financial Accounts for year-ended 28 February 2020 were filed at Companies House on 05 November 2020, had a turnover of £NIL. • The annual turnover for 2019 for Mega was stated as £225,000. • On 10 November 2020, a BBL of £50,000 was paid in to Mega’s bank account. • On 12 and 13 November 2020, £50,000 was transferred to a personal account of an associate to repay a debt that was personally guaranteed by Mr Patel and his co-director. • On 26 October 2022, Mega entered compulsory liquidation with known liabilities of £50,433, owed in respect of the BBL.
