On 14 May 2020, Olaguke Oladosu (“Mr. Oladosu”) caused Geelink Limited (“Geelink”) to make a Bounce Back Loan (“BBL”) application of £50,000 when he knew or ought to have known that Geelink did not meet the required turnover to be able to apply for a loan for this amount. Mr. Oladosu made a wrongful declaration by overstating Geelink’s turnover, as a result Geelink received BBL funds of £50,000 that it was not entitled to, in that. • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • Geelink was incorporated on 23 November 2016 and was therefore required to use turnover for the full calendar year of 2019. • Geelink’s accounts, filed at Companies House for the years ended 30 November 2019 show the Company as dormant. • Geelink’s bank statement shows income of £214 for the calendar year of 2019. The minimum turnover requirement for the BBL application would have been £8,000. • On 14 May 2020, Mr. Oladosu applied for a BBL of £50,000 declaring Geelink’s turnover for the 2019 calendar year as £200,000. • On receipt of the BBL on 15 May 2020, Geelink’s bank balance was £62. • On 22 June 2020, Mr. Oladosu received £1,348 from Geelink’s bank account. • On 24 June 2020, Mr. Oladosu received £12,000 from Geelink’s bank account. • On 08 July 2020, Mr. Oladosu received £32,000 from Geelink’s bank account. • Between 3 March 2021 and 4 October 2021 Mr Oladosu deposited £4,250 into Geelink’s bank account. • Between 15 May 2020 and 08 July 2020, Geelink did not receive any further income, therefore the use of BBL funds does not appear to have been used for the economic benefit of the Company which was in breach of the BBL terms and conditions. • At Liquidation, Geelink had liabilities of £57,307 of which £47,307 was the outstanding amount owed in relation to the BBL.
