In July 2020 Paul Coupland (“Mr Coupland”) caused Humber Metal Processors Ltd (“HMP”) to apply for a Bounce Back Loan (BBL) when he knew, or ought to have known, that HMP did not meet the criteria for the loan. In that: The Bounce Back Loan eligibility criteria stated that borrowers were required to declare that the business was established and operating on or before 1 March 2020 and had been adversely impacted by coronavirus (COVID-19). HMP was incorporated on 20 April 2020. The company bank statements show that the first transaction was on 30 April 2020. Therefore, the company was not established and operating on 01 March 2020 and was not eligible to receive a BBL. HMP applied for a BBL on 08 July 2020 declaring that the company was established on 1 February 2020 and HMP’s annual turnover was £260,000. The first payment of £30,000 of the BBL funds was paid into the company’s bank account on 13 July 2020 and the second BBL top up payment of £20,000 was paid into the same bank account on 04 June 2021. At liquidation on 07 November 2022, the £50,000 BBL was still outstanding.
