Peter Derek Boswell ("Mr Boswell") failed to ensure that Heritage Assets Limited ("Heritage") complied with its obligations to submit payments and/or returns to HM Revenue and Customs ("HMRC") in respect of Value Added Tax ("VAT") and Pay As You Earn and National Insurance Contributions ("PAYE/NIC") and caused Heritage to trade to the detriment of HMRC from at least 01 January 2016 to cessation of trading in March 2017. As a consequence, HMRC are owed £82,530 and are the largest creditor at liquidation. In particular: VAT • Heritage's VAT returns for 10/15 (due by 07 December 2015) to 07/16 inclusive show a total sum of £13,971.58 was due in relation to VAT which remained outstanding at liquidation plus associated surcharges of £863.10. • Heritage failed to file VAT returns for 10/16 to 04/17 resulting in Assessments totalling £11,452.00 plus associated surcharges of £1,322.55 which remained outstanding at liquidation. • Heritage's bank statements show that the company's income and expenditure significantly increased in the period 10/16 to 04/17 when Assessments were raised. • At liquidation the total amount due in relation to VAT and surcharges was £27,609.23. PAYE/NIC • Heritage was liable for PAYE/NIC in relation to its employees from month 11 onwards of tge tax year 2015/2016. • Heritage's PAYE/NIC returns for months 11 (due 19 March 2016) to 12 of 2015/2016 and months 1-8 of 2016/2017 show a total sum of £39,131.03 was due in relation to PAYE/NIC which remained outstanding at liquidation. • Heritage failed to file PAYE/NIC returns for months 9-12 of 2016/2017 resulting in Assessments totalling £15,567.42 which remained outstanding at liquidation. • Additional Class 1 NIC of £224.70 remained outstanding from 2014/2015. • At liquidation the total amount due in relation to PAYE/NIC was £54,923.15. Differential Treatment • In the period 01 January 2016 to liquidation there were receipts and payments into/out of Heritage's bank account of £427,206.41 and £426,896.80 respectively. Over the same period there were no payments to HMRC in respect of VAT or PAYE/NIC. • HMRC is the single largest creditor in the liquidation with a claim of £82,530 which began accruing from 07 December 2015 (when the VAT quarter 19/15 fell due).
