Between 01 January 2018 up to the date of liquidation on 18 December 2019 Stephen Robert Gray (“Mr Gray”) failed to ensure that Endeavour Strategic Ltd (“Endeavour”) complied with its statutory obligations to remit monies to HM Revenue and Customs when due in respect of PAYE/NIC (“HMRC”) and caused Endeavour to trade to the detriment of HMRC, resulting in PAYE liabilities at liquidation of £179,474 (excluding interest and charges) in that: The company entered into a 7 month TTP with HMRC on 12 May 2017 to address liabilities of £34,713. Whilst agreed payments were made, the company did not meet all its ongoing PAYE liabilities and when the TTP ended as at 31 December 2017 its PAYE liabilities were £39,860 compared with trade creditors of £4,321. From 01 January 2018 to 18 December 2019, only 1 payment was made to HMRC of £1,306 on 22 February 2018 and Endeavour failed to make all its required payments in respect of submitted PAYE returns of £147,193. In the period where the debt to HMRC has accrued, bank statements show that payments to other creditors have been maintained. As at the date of the liquidation on 18 December 2019, Endeavour had an unpaid liability in respect of PAYE of £179,747 compared with known trade creditors of £5,896.
