On 05 May 2020 and 03 November 2020, whilst acting in the capacity of director of Track 4 Services Ltd (“Track 4”), Robert David Ryce (“Mr Ryce”) applied, on behalf of Track 4, for a Government-backed Bounce Back Loan (“BBL”) of £15,000 and a top-up BBL of £30,000 resulting in Track 4 receiving £45,000 to which it was not entitled. In that: To be eligible for a BBL, a business had to be carrying on business at 01 March 2020. Track 4 was incorporated and commenced trading on 04 March 2020 and was not eligible for a BBL. Although not formally appointed as director of Track 4 until 19 November 2020, Mr Ryce was solely responsible for all aspects of its business from incorporation. On 05 May 2020, Mr Ryce submitted an application to Track 4’s bank, in the name of the de jure director, for a BBL of £15,000 stating the turnover was £180,000. As part of the online application process Mr Ryce had to declare that the company was carrying on business as at 01 March 2020. The BBL of £15,000 was received into Track 4’s bank account on 06 May 2020. On 03 November 2020, Mr Ryce submitted an application for a top-up BBL to Track 4’s bank, in the name of the de jure director, for £30,000. The top-up BBL of £30,000 was received into Track 4’s bank account on 11 November 2020. Track 4 ceased trading in October 2021; No repayments were made by Track 4 in respect of the BBL; Track 4 entered Creditors’’ Voluntary Liquidation on 10 August 2022; At liquidation Track 4 had nil assets and owed £59,473.78 to creditors including £46,316.19 to its bank in respect of the BBL.
