Mr Robert Guy Forway (“Mr Forway”) caused IBF Contractors Limited (“IBF”) to breach the terms of the Coronavirus Business Interruption Scheme (“CBILS”) in that the company obtained a loan of £197,000 on 06 May 2021 and failed to use the loan amount (or part of it) to repay in full a Bounce Bank Loan (“BBL”) of £50,000 that had been obtained on 16 October 2020, as required. In that: • On 15 October 2020, the company applied for a BBL of £50,000 from Bank A on behalf of IBF which was paid into IBF’s bank account on 16 October 2020 • On 27 April 2021, Mr Forway applied for a CBILs of £197,000 from a different lender, Bank B which was paid into IBF’s bank account on 06 May 2021. • The CBILs terms stated that "the Borrower (or, if the Borrower is part of a group, the Borrower's group) does not have an existing loan under the Bounce Back Loan Scheme (BBLS), the Coronavirus Large Business Interruption Loan Scheme (CLBILS) or the Bank of England's COVID Corporate Financing Facility (CCFF) or, if it does, this CBILs Loan will be used to repay the whole of any existing BBLS, CLBILS or CCFF loan”. • The CBILs funds were not used to repay the BBL, of which £42,804.57 was outstanding at liquidation. • IBF entered Creditors Voluntary Liquidation on 19 July 2022 • At liquidation, IBF had liabilities of £307,118 of which £234,804.57 was owed in respect of the BBL and CBILs.
