Between 1 December 2013 (being the earliest deposit paid to the company that was not repaid) to 27 June 2018 (being the last payment to the company that was not repaid), Mr Robert Mulholland (“Mr Mulholland”) as the sole formally appointed director of Mulholland Development (UK) Limited (“MDU” or “the Company”) failed to ensure that the Company complied with its statutory obligations under The Housing Act 2004 to place deposit moneys held on behalf of tenants within approved schemes in order that such deposits be protected and to protect the deposit and rent funds within a designated client account to the value of £23,750. As a result: a) 5 deposits from 5 tenants were not protected and at least 5 of the respective landlords or The Deposit Scheme (TDS) became liable for those deposits, causing a loss of £6,604. b) 5 deposits from 5 tenants were incorrectly registered because Mr Mulholland was registered as a landlord when he should have been registered as an agent. If the company was not put into liquidation, TDS would have terminated the company’s membership. At least 5 respective landlords or TDS became liable for those deposits, causing a loss of £6,955. c) Mulholland continued to take deposits after the winding up petition was filed on 27 February 2018, some of which remain outstanding at Liquidation. d) 3 landlords were not paid over rent due to them that was paid to MDU from the respective tenants to the value £10,191. 2. From at least 01 August 2015 to Liquidation, Mr Robert Mulholland, whilst being the sole formally appointed director, failed to ensure that Mulholland Development (UK) Ltd (“MDU” or “the Company”) maintained and/or preserved adequate trading records, or in the alternative he failed to deliver up such records as were maintained and/or preserved. A box of records was delivered up to the Official Receiver on 31 January 2019 but the records were inadequate. As a consequence the Official Receiver is unable to: a) verify the full income and expenditure of the Company throughout trading period of 1 August 2015 to 18 February 2016 were no company records were delivered up. b) verify the expenditure of 322 payments amounting to £94,659 out a total of £424,780 being made from the Company’s account during the period 30 December 2016 to 13 August 2018 where bank statements were delivered up. This figure is made up of payments to; a. 70 cash payments of £32,958 b. 16 payments to unidentified bank accounts of £7,460 c. 236 other unexplained payments of £54,061 c) establish the position regarding the amounts owed in respect of deposits collected by the company that should have been secured as Mr Mulholland used his own personal bank account as well as the company’s bank account to collect rent and deposits and make payments on its behalf. a. the company appears to have received rent and deposits amounting to £318,268 into the company’s bank account during the period 30 December 2016 to 14 May 2018 b. payments appearing to represent rent and deposits amount to £230,140 out of the company’s bank account during the period 3 January 2017 to 7 March 2018. No schedule of rent or deposit per customer has been provided by Mr Mulholland.
