Between 01 May 2017 and liquidation on 29 November 2018, Rosie Simmons (“Ms Simmons”) failed to ensure that TT Developments (NW) Ltd (“TTD”) maintained adequate books and accounting records, or, in the alternative, to preserve and deliver up to the Liquidator such records as were maintained, as a consequence of which it has not been possible to explain the following: • The bank account owned by TTD shows two transactions for the entirety of trade; on 19 April 2018, £22,038 was credited to the bank account of TTD. On 25 April 2018, £22,038 was debited from the bank account of TTD. • At interview a co-director of TTD, stated that his personal bank account was used to conduct the business of TTD. • The co-director provided personal bank statements for the period 01 June 2016 to 29 November 2018. • Between 01 May 2017 and 29 November 2018, the co-director received funds totalling £910,572 into his personal account. In the same period, funds totalling £933,776 were debited from the co-director’s personal account. • It is not possible to determine the income or expenditure of TTD between 01 May 2017 and 29 November 2018, or whether such expenditure was for the benefit of TTD, by reference to the books and records that have been made available. • It is not possible to verify how much was due to HMRC in respect of Value Added Tax, Pay As You Earn, National Insurance Contributions, or Construction Industry Scheme liabilities, by reference to the books and records that have been made available. • It is not possible to verify the cause of failure of TTD by reference to the books and records that have been made available.
