Rajendra Kumar Ram (“Mr Ram”) caused Dal Cuisine Limited (“the company”) to trade to the detriment of HM Revenue & Customs (“HMRC”) in respect of Value Added Tax (“VAT”) as a consequence of him failing, at the relevant time, to submit VAT returns and make relevant payment of the VAT due on assessment from the end of VAT quarter January 2017 resulting in an unpaid VAT liability of £62,625 on 16 July 2019 when the company was placed into liquidation, in that: • In the absence of the company submitting VAT returns for 4 consecutive VAT quarters between January 2017 and October 2017 HMRC issued assessments totalling £2,729 against which the company paid £1,276 resulting in an unpaid liability of £1,453. • On 19 April 2018 the company submitted financial information to HMRC revealing the true VAT liability owed for the 4 consecutive VAT quarters between January 2017 and October 2017. Consequently, to recover the true level of VAT due, HMRC issued assessments totalling £49,759 which attracted penalties of £3,986. Although the company was requested to pay the increased VAT liability of £53,745 immediately it failed to do so. • In the absence of the company submitting VAT returns for 6 consecutive quarters between January 2018 and April 2019 HMRC issued assessments totalling £4,211 which attracted surcharges of £375 which the company failed to pay. As a result, the outstanding liability increased to £58,311, which in the absence of payment attracted interest of £2,842 increasing the unpaid liability to £61,153 • Post liquidation financial information disclosing the true level of VAT owed by the company between January 2018 and July 2018 was submitted revealing the true liability owed by the company at liquidation amounted to £62,525. Comparative treatment • The company’s financial statements for the year to 31 October 2017 disclose the company made payments to trade and expense creditors totalling £398,921. In the following year to 31 October 2018, the company’s payments to trade and expense creditors totalled £237,265. • Although no financial information is available to verify the level of payments made in the period November 2018 to July 2019 HMRC is the company’s only creditor at liquidation, suggesting full payment of trade and expense creditors continued to liquidation. In comparison in respect of the VAT liability HMRC received only 2 payments during the entire trading period. The first payment in the sum of £623 was made on 17 March 2017 and the second payment of £653 was made on 16 June 2017.
