Mr Sagar Bhattarai (“MR BHATTARAI”) caused or allowed Latimer Enterprises Limited (“LATIMER”) to deliberately suppress and conceal sales figures which resulted in the company under-declaring and underpaying VAT and Corporation Tax, ultimately being to the detriment of HMRC, in that:<br>HMRC officers made unannounced visits on 27 September 2017, 7 March 2018 and 9 March 2018, and subsequently met with MR BHATTARAI on 11 June 2018 to discuss information that HMRC had obtained from the Merchant Providers used by LATIMER. HMRC established that the company had been suppressing its sales figures.<br>On 27 February 2019, HMRC raised a VAT officer assessment for £64,222 including interest for the quarters ending November 2013 to May 2018.<br>On 07 March 2019 HMRC issued Notice of VAT Civil Penalties totalling £36,490 for the deliberate under declaration of sales during the quarters ended November 2013 to May 2018.<br>In a letter dated 14 March 2019 HMRC informed MR BHATTARAI that they took the view that he had benefitted personally from the suppression of sales income and that omitted gross sales should be treated as loans to him from LATIMER. HMRC have claimed revised Corporation Tax plus Section 455 Tax totalling £151,201 for the year ended 31 January 2015 to the year ended 31 January 2018.<br>On 03 April 2019 HMRC also issued notice of Corporation Tax Penalties totalling £79,381 for the deliberate inaccuracies.<br>Personal Liability Notices were issued by HMRC for £79,381 in respect of the Corporation Tax Penalties and £18,637 in respect of the VAT Civil Penalties.<br>On 7 March 2019 LATIMER entered Liquidation with HMRC submitting a claim of £356,771.
