Scott Dylan (“Mr Dylan”) contravened Section 11 of the Company Directors Disqualification Act 1986 by acting as a director of SDRW Limited (“SDRW”) from 08 July 2013 to 22 July 2015, whilst he remained undischarged from a Bankruptcy Order made against him in the Milton Keynes County Court on 26 July 2005 upon the petition of a creditor. a. Mr Dylan was appointed as a director of SDRW when it was incorporated on 08 July 2013. b. Form TM01 lodged with the Registrar of Companies shows that Mr Dylan’s directorship of SDRW was terminated with effect from 13 July 2014, though this was not filed until 22 July 2015. c. SDRW commenced trading in December 2014, and Mr Dylan was an active director from the date of his appointment until at least 22 July 2015. d. A Bankruptcy Order was made against Mr Dylan in the Milton Keynes County Court on 26 July 2005 upon the petition of a creditor. e. On 20 January 2006, upon the application of the Official Receiver, an Order was made in the Milton Keynes County Court suspending Mr Dylan’s automatic discharge from his bankruptcy until such time as he complied with his bankruptcy obligations under the Insolvency Act 1986. f. A proposal made by Mr Dylan for an Individual Voluntary Arrangement was approved by his creditors on 11 August 2015, and on 10 November 2015 the Bankruptcy Order made against Mr Dylan on 26 July 2005 was annulled in the County Court at Milton Keynes pursuant to Section 261(2) (a) of the Insolvency Act 1986. g. Mr Dylan therefore remained an undischarged bankrupt from 26 July 2005 until 10 November 2015, and specifically throughout the whole of the period from 08 July 2013 to 22 July 2015 when he was a director of SDRW.
