From at least 01 December 2015 Simon David Bennett Jones (“Mr Jones”) caused CWJ Developments Ltd (“CWJ”) to fail to ensure accurate VAT, PAYE and CIS tax returns were submitted by CWJ up to liquidation on 01 March 2018. The amount of £937,696 is claimed by HMRC as the sole creditor in the liquidation. • HMRC met with Mr Jones on 21 September 2016 as part of a review of CWJ’s tax affairs. During the meeting HMRC established potential inaccuracies in CIS, PAYE and VAT liabilities dating back to the 2011/12 financial year based on information supplied by Mr Jones. • On 30 November 2016 HMRC notified Mr Jones of their intention to issue assessments for CIS and PAYE as a result of the information supplied by Mr Jones on the status of employees and sub contractors used by CWJ which generated increased liabilities. • On 20 April 2017 HMRC highlighted discrepancies between VAT return amounts and Year End Company accounts that meant a number of transactions (Credits) had been paid into the Company account without being invoiced or subjected to VAT. • On 28 September 2017 HMRC confirmed they had uncovered substantial differences between the turnover in the company accounts and the figures that were included in the company CT and VAT returns. • As a result of their investigation HMRC issued assessments of £217,387.13 in regards CIS, £42,665.90 in regards PAYE, £245,639.23 in regards additional VAT (including £16,023.57 interest) and £250,731.66 in regards to additional CT (including £22,264.93 interest). • HMRC also issued an Inaccuracy Penalty under Schedule 24 of the Finance Act 2007 totalling £115,947.49 to Mr Jones personally in regards of potential lost earnings. HMRC deemed Mr Jones deliberately failed to maintain his Director’s Loan Account properly and subsequently withdrew substantial funds from the company without subjecting them to the relevant tax.
