Between 18 September 2020 and 23 September 2020 Simon James Rooney ( “Mr Rooney”) caused White Rhino Group Ltd ( “WRGL”) to breach the conditions of the Bounce Back Loan (“BBL”) scheme by transferring funds totalling £44,500, obtained under the BBL scheme, to his personal bank account and not utilising them for WRGL’s economic benefit. In that: A requirement of the BBL scheme was that the loan be used for the economic benefit of the applying company. Immediately before the receipt of the BBL,WRGL’s bank account held a credit balance of £86.66. On 03 September 2020 WRGL applied for a BBL of £50,000 On 18 September 2020 the BBL of £50,000 was credited to WRGL’s account . Between 18 September and 23 September 2020, four transfers were made to Mr Rooney’s personal bank account, amounting to £44,500. Mr Rooney has failed to provide documentary evidence that the £44,500 transferred to him was utilised for WRGL’s economic benefit. WRGL’s bank statements fail to show any repayments in respect of the BBL and the BBL provider is listed as a creditor for the full £50,000 at Liquidation.
