Simon Lee Tate (“Mr Tate”) failed to ensure that TJT Drywall Solutions (“TJT”) maintained, preserved and or delivered up adequate accounting records to the liquidator, such that it is not possible to satisfactorily explain expenditure of company monies totalling £40,926 following the presentation of a winding up petition against the company on 11 April 2017. In that:<br>On 11 April 2017 a creditor presented a winding up petition against the company.<br>In the period from 21 April 2017 to 30 June 2017 payments totalling £57,883 were made into the company bank account, of which £33,960 was paid on directly to the personal bank account of Mr Tate. By contrast in the period 01 March 2016 to 21 April 2017 only £7,510 was paid into Mr Tate’s personal account from TJT’s bank account.<br>A further £50,271 that can be identified as company income was deposited directly into Mr Tate’s personal account after 21 April 2017 by customers of TJT.<br>In total £84,231 that can be identified as company money was deposited into Mr Tate’s personal account after 21 April 2017, following the presentation of the winding up petition on 11 April 2017.<br>Mr Tate has failed to provide records that can explain the following payments: - Expenditure totalling £5,040 from the company bank account between 21 April 2017 and 30 June 2017 - Expenditure of company monies totalling £8,073 from Mr Tate’s personal bank account between 21 April 2017 and 30 June 2017 - Expenditure of company monies comprising the credit balance of £12,652, existing on Mr Tate’s personal bank account at 30 June 2017 - Expenditure of further company monies deposited into Mr Tate’s personal bank after 30 June 2017, totalling £15,161<br>The creditor that presented the petition on 11 April 2017 did not receive any payment in the period after the petition was presented. At liquidation there were 4 known creditors totalling £34,581
