Between 01 September 2020 and 03 November 2020, after Cherished and Devoted Care Ltd (“Cherished”) had voluntarily surrendered its Ofsted licence and was unable to trade, Stuart Andrew Corrie ( “Mr Corrie”) caused Cherished to make payments totalling £92,230, which were to the detriment of Cherished’s remaining creditors and caused Cherished to become insolvent, in that: • On 26 August 2020 Ofsted issued a Notice of removal of licence to Cherished. • On 27 August 2020 the Ofsted licence was voluntarily surrendered by Cherished. • From 01 September 2020 Cherished’s bank account received credit of £87,237 accounted for by an insurance payment of £58,173, Covid-19 financial support of £27,886, a loan of £1,000 and reversed charges of £179. • Between 01 September 2020 and 30 October 2020 Cherished made net payments totalling £56,230 to the landlord of the trading premises, a company with a connected individual registered as a director, in full settlement of Cherished’s liability to the company. • On 03 November 2020 Cherished made a payment of £17,500 to a former director of Cherished, in respect of an outstanding DLA liability. The payment was in full settlement of his outstanding DLA liability. • On 03 November 2020 Cherished made a payment of £17,500 to another former director of Cherished, in respect of an outstanding DLA liability. The payment was in full settlement of his outstanding DLA liability. • During the period 01 September to the date of liquidation, payments made by Cherished to other parties totalled £22,820 accounted for by wages of £11,900, trade and expense costs of £10,680 and interest/charges of £240. • On 27 January 2021 Cherished entered into creditor’s voluntary liquidation with assets of £6,000 and liabilities of £93,724.
