Sultan Mahmood Rashid (“Mr Rashid”) failed to ensure that Twelve-By-Seventy-Five Limited (“12x75”) procured sufficient cases of wine to satisfy all the purchases made by its customers and failed to protect the customers’ investment or monies, as follows: 12x75 acted as a broker for fine wine investors. 12x75 failed to purchase sufficient cases of wine to fulfil orders made by its clients, for which 12X75 received payment, resulting in a loss to known customers that totalled at least £691,680 at the winding up. From 9 January 2017 onwards, 12x75 failed to reimburse at least £299,631 to customers in respect of wine sold on their behalf. When the company went into Liquidation and ceased to trade, there was wine with a maximum value of £77,000 available. Fifteen clients have claimed in the Liquidation for £1,266,311 in respect of their investment money. Mr Rashid has failed to provide adequate records or explanation of what has happened to the wine or monies of 12x75’s clients. As at 31 January 2017, 12x75’s accounts showed overdrawn director loan accounts of £657,171 in respect of Mr Rashid and a co-director. Mr Rashid approved the transfer of 12x75’s future pension liability from the company to himself and a former director on 5 May 2018 and in consideration, the director loan accounts of £657,171 as at 31 January 2017 were treated as repaid. - Between 1 February 2017 and 25 July 2018 sums of at least £366,939 were paid by 12x75 to Mr Rashid’s personal bank accounts.
