Shane Danny Boutwell (“Mr Boutwell”) failed to ensure that Euro Road Surfacing Ltd (“ERS”) maintained and/or preserved adequate accounting records from 01 August 2019 (the day after the last set of prepared accounts) to Liquidation or alternatively he failed to deliver up adequate accounting records to the Liquidator. As a consequence of the lack of records and other documentation, it has not been possible to deal with the following matters or identify: • What has happened to plant, equipment and motor vehicles, with net book value of £180,000 and outstanding finance of £150,000 said to have been sold to the director’s new company and whether any sale of the assets were for a fair value and any sale proceeds applied for the benefit of ERS. • The true value of two trucks purportedly sold by ERS to a third party and invoiced for a total of £7,000 plus VAT, valued by the liquidator’s agents, on a desktop, unseen, basis at between £22,000 and £27,000 and if any sale proceeds were applied for the benefit of ERS. • What has happened to the material supplies costing circa £160,000, supplied by 2 third party companies in the final 2 or 3 months, prior to liquidation. • Exactly how much is owed to ERS by its debtors, including the Director’s other companies for assets acquired from ERS. • The balance on the Director’s current account. • When ERS actually ceased to trade.
