Mr Spas Spasov caused DSD Contractors Ltd (“DSD”) to breach its statutory obligations to Her Majesty’s Revenue and Customs (“HMRC”) and caused DSD to trade to the detriment of HMRC by failing to remit payment in respect of Pay As You Earn (“ PAYE/NIC”) from 22 November 16 and Value Added Tax (“VAT”) from 7 October 2016 until liquidation on 8 August 2017, resulting in a claim from HMRC in the liquidation totalling £268,18, In that : PAYE/NIC • DSD submitted a return for the period to 5 November 2016 for £45,518, against which payments of £6,299.34 were made on 23 March 2017 and £35,000 was made on 6 April 2017, leaving a sum of £3,251.98 outstanding at liquidation • DSD submitted returns for the periods end 5 December 2016 – 5 July 2017 totalling £233,609.14 against which no payments were made, and which remains outstanding at liquidation. VAT • For the periods ending 08/16 – 05/17, returns were submitted declaring liabilities with respect of VAT totalling £93,461.80 against which payments were made totalling £310.21, leaving a resultant liability at liquidation totalling £93,151,59. Comparative Treatment DSD’s records disclose income received in its period of trading to be in the order of £3million. Of this income £156,261 was paid to HMRC whilst the balance was paid away to third parties. HMRC have a claim of £369,232 in the liquidation and other creditors were owed £12,090.
