Stephen James (“Mr James”) caused or allowed BB Creative Communications Ltd (“BB”) to trade to the detriment of HM Revenue &amp; Customs (“HMRC”) in respect of Corporation Tax from at least 01 January 2015 and in respect of VAT from 07 June 2015 until the date of the Winding Up Order on 13 February 2019 resulting in liabilities to HMRC at liquidation of at least £75,247, in that:<br>Mr James was not a formally appointed director until 02 April 2015, but acted as a director of BB prior to his formal appointment.<br>Corporation Tax returns for the two year period ending 31 March 2015 showed a liability of £42,517, against which payments of £4,036 were made. £38,481 is owed at liquidation.<br>BB submitted VAT returns totalling £33,961, together with one VAT reclaim of £1,176 between the quarters ending April 2015 and January 2017. HMRC raised surcharges totalling £4,850. BB made payments against the VAT returns of £9,272, and HMRC also used the reclaim of £1,176 against the VAT liability owed for the quarter ending April 2015, leaving an amount outstanding of £28,363.<br>No further VAT returns were submitted, and HMRC raised assessments of £6,284 for the VAT quarters ending April 2017 and July 2017, together with surcharges of £943. In total, HMRC are owed £35,590 in respect of VAT.<br>The oldest debt to HMRC is Corporation Tax for the period ending 31 March 2014, due no later than 01 January 2015. Accounts for the period 31 March 2014 to 31 August 2015 detailed sales of £220,876. The account also detailed an increase in a DLA attributed to Mr James’ co-director of £67,157 to £123,075.<br>No further accounts have been produced after 30/09/15. Bank statements have been obtained, and between 01/10/15 and 07/03/18 there were receipts of £236,110, and payments of £236,369. Of the payments made, £53,019 was paid to a bank account in the name of Mr James’ co-director whilst a further £43,221 was paid on behalf of the co-director. During the same period, bank statements show payments to HMRC totalling £18,058.
