In May 2020, Steven Hastings (“Mr Hastings”) caused Steve Hastings Drain Services Ltd (“SHDS”) to breach the terms and conditions of the Bounce Back Loan (BBL) facility by applying for a BBL of £50,000 when he knew or ought to have known that SHDS was not entitled to the loan having previously applied for and received a £50,000 BBL from a different financial institution. In that, • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover for the calendar year 2019. The turnover figure was self-certified by the applicant. The BBL scheme eligibility criteria allowed for businesses to only receive one BBL. • SHDS operated two bank accounts, one with Bank A and one with Bank B • On 06 May 2020, SHDS received a £50,000 BBL from Bank A • On 12 May 2020, SHDS received a £50,000 BBL from Bank B • SHDS breached the terms of the BBL scheme by obtaining the second BBL. • By obtaining a second BBL, SHDSL received at least £50,000 more than it was entitled to. • At liquidation on the 21 November 2022, there was £48,458 outstanding to Bank A and £50,845 outstanding to Bank B in respect of the BBLs.
