On 27 June 2020, Sukhdev Ram Bhana (“Mr Bhana”) caused SRB Property Ltd (“SRB”) to obtain a government-backed Bounce Back Loan (“BBL”) of £50,000 when he knew, or ought to have known, that SRB was not eligible for any loan under the terms of the BBL Scheme. In that: • under the BBL scheme a business was able to borrow up to 25% of its turnover in calendar year 2019, up to a maximum of £50,000 and, if the business was established after 1 January 2019, it was to apply the 25% limit to its estimated annual turnover from the date it started. The BBL was to be used only for the economic benefit of the business, used wholly for business purposes and not personal purposes. • to be eligible to apply for the BBL, a borrower had to declare the company was carrying on its business on 1 March 2020 and that it was engaged in trading or commercial activity in the United Kingdom as at the date of the application. • SRB was incorporated on 13 November 2019. • on 27 June 2020, Mr Bhana applied for a BBL of £50,000 on behalf of SRB stating in the loan application that SRB’s relevant turnover was £200,000. • SRB’s company bank statements do not indicate that it was carrying on business on 1 March 2020 nor on or around 29 June 2020; it was therefore not eligible to apply for a BBL. • SRB submitted dormant accounts for the Year Ended 30 November 2020. • on 29 June 2020, funds of £50,000 were credited to SRB’s bank account. • between 1 July 2020 and 22 July 2020, £49,995 of BBL funds was paid out from the company bank account in various unaccounted for transactions. • these payments were not for the economic benefit of SRB and were contrary to the terms of the BBL scheme. • at the date of the liquidation on 3 January 2023, the Statement of Affairs shows that total liabilities amounted to £50,250, of which £50,000 was in respect of the BBL.
