Mr Kandiah caused New Brands to apply for a Government backed Bounce Back Loan (“BBL”) of £50,000 that it was not eligible for, having obtained a previous BBL for £25,000 on 11 May 2020 from a different lender, in that: A Company was entitled to apply for one BBL of up to 25% of its 2019 turnover up to a maximum of £50,000 under the BBL scheme. On 8 May 2020, Mr Kandiah applied for a BBL of £25,000 from National Westminster Bank Plc (“NatWest”) on behalf of New Brands. On 11 May 2020, New Brands received a BBL of £25,000 from NatWest on behalf of New Brands which was paid into the company bank account. On 1 July 2020, Mr Kandiah applied for a second BBL of £50,000 with a different lender; Metro Bank Plc (“Metro Bank”) On 2 July 2020, New Brands received a payment of £50,000 from Metro Bank into a company bank account in respect of its BBL application. The BBL terms and conditions in respect of Metro Bank required the applicant to self-declare that they had not made any other application for a Bounce Back Loan for the business. Mr Kandiah falsely declared that New Brands had not previously applied for and obtained a BBL with another lender. On 1 March 2022 New Brands was Wound Up in the County Court of Croydon with total liabilities of £121,167.52 of which included the amount owed in respect of the BBLs.
