Terence Roscoe (‘Mr Roscoe’) whilst not appointed as a de jure director acted as one throughout the whole trading period and failed to ensure Prometheus UK Holdings Ltd (‘Prometheus’) complied with its statutory obligations to remit payment when due in respect of VAT between 7 July 2015 and 14 November 2018 (WUO), in respect of PAYE between 23rd May 2015 (Due for April 2015) to 14 November 2018 (WUO) therefore caused ‘Prometheus’ to trade to the detriment of HMRC. At the date of liquidation HMRC are owed £58,309.17 attributable to the non-payment of VAT and £48,043.24 attributable to PAYE non-payment VAT<br>As of 7 July 2015, the return submitted for the 05/15 VAT period was unpaid and left a balance outstanding of £2,852.21 in the liquidation. A further 9 VAT returns totalling £49,824.18 were submitted by Prometheus and HMRC raised assessments for the 02/18, 05/18, 08/18 and 11/18 periods totalling £19,612.00.<br>In the period, Prometheus made payments of £13,979.22 against the liability.<br>The VAT liability increased in the period by £55,456.96 from £2,852.21<br>HMRC have claimed £58,309.17 in the liquidation for VAT (excluding surcharges of £5,228.93), a total of £63,538.10. PAYE<br>In the 2015/2016 PAYE/NIC year, Prometheus submitted a monthly return of £2,310.34 for April 2015 which was due to be paid by 22 May 2015, therefore Prometheus was in arrears of PAYE/NIC from 23 May 2015.<br>HMRC records indicate £38,348.91 was paid and attributed to PAYE between December 2015 and January 2018, however the payments were not enough to clear the accruing liability.<br>In the period between 23rd May 2015 to 14 November 2018 the PAYE/NIC liability (excluding penalties and interest) increased by £39,832.86 from £2,310.34, to a total of £42,143.20<br>HMRC have submitted a POD for PAYE/NIC of £42,143.20 (excluding a £500 penalty and interest of £698.52), a total of £43,341.72.
