Thomas Edward Bell failed to ensure that Valde Construction Ltd (‘VCL’) complied with its statutory obligations to file returns and to make payments when due to HM Revenue & Customs (‘HMRC’) for PAYE/NIC/CIS and VAT and as a consequence caused it to trade to the detriment of HMRC from at least 07 November 2016 when VAT for September 2016 fell due, to its cessation in August 2019. As a consequence HMRC is owed at least £364,451 at the liquidation date. In that: • VCL did not pay its VAT on time from at least the quarter to September 2014 which was not settled until August 2015; • The return for the quarter to December 2017 was the last submitted and HMRC raised assessments totalling £40,497 for the quarters March 2018 to VCL’s liquidation; o However a return prepared by the accountant shows VAT of £121,811 was due for this period; • The last payment made to VAT was on 17 October 2018, this was allocated to part pay the return for September 2016, leaving a balance of £3,644 outstanding; • This quarter should have been settled by 07 November 2016; • VAT totalling £125,455 was unpaid at the date of VCL’s liquidation; • HMRC’s claim includes interest due for PAYE/NIC/CIS for the tax year 2016/17 which was not paid on time; • For the tax year 2017/18 a total of £110,973 was due, payments and credits were £17,969, leaving a balance outstanding of £93,004; • No returns were submitted from April 2018 and HMRC raised assessments; • The accountant has confirmed that no CIS deductions were made from payments totalling £733,559 to sub-contractors; o At 20% this would result in CIS tax due to HMRC of £146,712 o Payments allocated to 2018/19 were £18,000 (no payments were made to the following year); o Giving an estimated additional amount due of £128,712. • A total of £221,716 was therefore outstanding for PAYE/NIC/CIS at the liquidation date; • Accounts show that HMRC was owed £82,174 as at 31 December 2016, by the liquidation date at least £364,451 was due to HMRC; • Trade creditors were owed £12,108 in December 2016 and £25,176 at the liquidation date; • Bank statements from 01 April 2018 show payments out of £1,588,138, of which £25,000 was paid to HMRC.
