From commencement of trade until liquidation, I as the sole director of Simmonds Music Limited (“SML”) committed fraud in that; ? Amongst other things, SML business was to repair and sell musical instruments on behalf of customers, on a sale or return basis (less the cost of repairs). Customers would receive the proceeds of sale after SML had deducted a commission; ? During trading SML either sold, or disposed of, thirty-seven musical instruments that belonged to customers. No proceeds of sale were remitted to these customers and/ or their musical instruments were not returned. These thirty-seven customers have submitted claims in the liquidation totalling £188,258; ? Following complaints made by customers to the police, criminal proceedings were brought against me . On 31 July 2019, I pleaded guilty to four counts of fraud at the Lincoln Crown Court which resulted in a nine-month suspended sentence along with a four-month curfew.
