Wayne Pitt (“Mr Pitt”) failed to ensure that Speedy Piling and Building Services Ltd (“SPBS”) complied with statutory obligations to remit returns and make payments as and when due to HM Revenue and Customs (“HMRC”) in respect of Value Added Tax (“VAT”), and caused Speedy Piling and Building Services Limited (“SPBS”) to trade to the detriment of HMRC from at least 07 April 2014 until liquidation on 18 January 2018 in respect of VAT. VAT • Mr Pitt voluntarily registered SPBS for VAT effect 20 September 2012. • SPBS submitted a single VAT return for the quarter ending 11/2012. SPBS did not submit any other VAT returns throughout the entirety of trade. • HMRC issued assessments for all periods from 02/2013 to 11/2017, against which payments totalling £18,991 were made, leaving £6,440 outstanding by the end of VAT period 11/17 against these assessed amounts. • During an inspection by HMRC officers of SPBS’s trading premises on 19 October 2017, Mr Pitt confirmed that he was aware that VAT returns had not been submitted. • In a letter dated 27 November 2017, HMRC instructed Mr Pitt to submit all of SPBS’s outstanding VAT returns. • In the absence of returns HMRC subsequently raised assessments of an additional VAT liability for all periods between 02/2014 to 11/2017 inclusive, totalling £22,030, and a further officers assessment of £154,672 covering periods 02/2014 to 11/2017. • SPBS made no other payments to HMRC at any other time in respect of VAT. Differential Treatment • Between 7 April 2014 and Liquidation, SPBS received £2,656,284 into the daily operating account. • £84,890 was paid to HMRC • In the same period, SPBS made payments totalling £2,673,665, which includes the following; • Payments to Mr Pitt totalling £131,645. • Payments to a connected company, of which Mr Pitt is the sole director and shareholder, totalling £69,350. • Cheque payments to various creditors totalling £438,639. • Payments to a single trade creditor totalling £247,630. • HMRC are the largest creditor at liquidation with a claim totalling £221,296 out of total claims of £295,117.
