William Chamberlain (‘Mr Chamberlain’) caused Lair Productions Ltd (‘Lair’) to make a Bounce Back Loan (“BBL”) application of £50,000 when he knew, or ought to have known that Lair was not eligible for such a loan. Mr Chamberlain made a wrongful declaration by overstating Lair’s turnover, as a result Lair has received BBL funds of £50,000 that it was not entitled to.?? ?? Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover.?? ? Lair was incorporated on 16 May 2015, with Mr Chamberlain becoming a director on 22 February 2016, and subsequently becoming the sole director on 05 October 2020. ? On 30 November 2020, Mr Chamberlain applied for a BBL of £50,000 on behalf of Lair declaring that its turnover for the calendar year 2019 was £4,000,000.? ? Accounts for the financial years ending 31/07/17, 31/07/18, 31/07/19 and 31/07/20 confirmed that Lair had no turnover at any point during the 4 years. As Lair had no turnover, it was not eligible for a BBL. ?? Lair received the BBL funds of £50,000 on 08 December 2020.?On 13 December 2020, the entire £50,000 was transferred to another company of which Mr Chamberlain was the director. ? Total liabilities at liquidation amount to £53,555 of which £50,000 relates to the amount owed in respect of the BBL.?
