Yogesh Toora (“Mr Toora”) failed to comply with his statutory duties to ensure that Absotherm Services Ltd (“ASL”) made timely payments and returns as and when due to HM Revenue & Customs (“HMRC”) in relation to Value Added Tax (“VAT”) from 07 January 2014. As a result, Mr Toora allowed ASL to trade to the detriment of HMRC from 07 April 2015 in respect of VAT and from 22 July 2014 in respect of PAYE/NIC, until June 2018: VAT • HMRC’s claim for VAT is £27,321.11 including surcharges of £3,187.80. • HMRC’s records show that ASL did not submit VAT returns from at least the 11/13 VAT quarter until the 05/18 quarter. HMRC calculated assessments for these periods totalling £14,544.50. • ASL fell into arrears with VAT on 07 April 2015 at the latest, when payment for the assessment for the quarter 02/15 of £688.00 fell due and was not paid in full. • As a result of ASL’s failure to submit full payments as and when due, HMRC applied default VAT surcharges of £4,804.26. • During the period from 07 April 2015 to 08 January 2016, ASL made payments amounting to £1,509.10 to HMRC in respect of VAT. No payments were made after January 2016. PAYE • HMRC’s claim for PAYE is £48,488.57, including penalties and interest, owed for the period 22 July 2014 until June 2018. • HMRC records show 3 payments were made to HMRC by ASL in respect of PAYE amounting to £7213.54. • Two payments were made in February and April 2015. The last payment made in respect of PAYE was on 15 March 2017. Comparative Treatment • The creditors at the date of Liquidation are the Director and Secretary owed £1,220.00 and HMRC owed £91,068.14. • Bank statements for the period 01 July 2016 to 07 September 2018 show that ASL paid £2,715.57 to HMRC, while paying £295,945.80 to trade creditors and £166,447.40 as wages.
