On or around 28 April 2017 Mr Alexander James Gibbons (“Mr Gibbons”) diverted monies from an insurance claim due to AJG Property Maintenance & Servicing Limited (“AJG”) into a bank account held in the name of an associated company when AJG was insolvent. As a result, at least £34,750 was not made available to, or expended on behalf of, AJG and its creditors. In that: • In August 2016 AJG took out an insurance policy in the company’s name • During March 2017, Mr Gibbons was informed by AJG’s accountant that AJG was insolvent and sought advice from an Insolvency Practitioner. • On 19 April 2017, a claim was made on the insurance policy • On or around 19 April 2017 AJG ceased trading. • On 28 April 2017 Mr Gibbons sent an email to the insurance company with the sort code and account number for the claim to be paid to. These bank details were for an associated company. • On 02 May, 04 May and 09 August 2017, the insurance company paid the following amounts in settlement of the insurance claim £20,000, £8,250, and £6,500 respectively. • An analysis of the bank account of AJG do not show payments from the insurance company or transfers from the associated company for any of the sums paid by the insurance company • On 29 August 2017, Mr Gibbons signed a statement of affairs in which he declared assets of £18,000 due from an insurance claim, when the insurance company had already made payments in settlement of the claim. • On 12 September 2017, AJG entered into liquidation with total liabilities of £143,310.
