- Between 23 March and 05 June 2021, Mr Bashkim Hoxha (‘Mr Hoxha’) caused AMIR FRAME LIMITED (‘Amir’) to make payments for his own personal benefit of at least £46,709, which were to the detriment of Amir’s creditors and at a time when he knew or ought to have known that Amir would become insolvent as a result, in that: Amir ceased trading on 22 March 2021. As at 22 March 2021, Amir had liabilities of at least £36,722, in respect of bank loans and outstanding tax liabilities and the only company asset was £43,000 held in the company bank account. Between 23 March and 05 June 2021 an additional £13,424 was paid into Amir’s bank account, being an outstanding trade receipt of £9,924, covid relief of £3,300 and £200 from Mr Hoxha. Between 23 March and 05 June 2021, Mr Hoxha received payments from Amir’s bank account totalling £40,500. In addition, £6,209 was transferred out of the account in respect of payments to Mr Hoxha’s personal mortgage account. In the same period Amir made payments totalling £649 towards its bank liabilities and a single payment of £237 was made to HMRC. The Statement of Affairs filed within the liquidation proceedings showed £0 assets together with unsecured liabilities of £53,749 (being sums owed to HMRC of £23,053 and to a bank of £30,695). The bank has scheduled a claim within the liquidation proceedings of £35,397 in respect of a Bounce Back Loan of £25,000 (originally received on 24 June 2020) together with the balance of a business loan of £5,387 (of which £6,035 was outstanding on 22 March 2021) and an overdraft facility of £5,010. HMRC have scheduled a claim within the liquidation proceedings of £10,404 including £8,994 in respect of VAT which was based on Returns (03/20 of £2,690.17, 09/20 of £2,997.48, 03/21 of £2,152.30 and 06/21 of £1,154); of which £5,687.65 would have been due for payment by 22 March 2021.
