- On 09 October 2020 Craig John Whetlor (“Mr Whetlor”) caused CJW Construction Limited (“CJWC”) to obtain a £50,000 Bounce Back Loan (“BBL”) but did not use it to repay CJWC’s existing Coronavirus Business Interruption Loan (“CBIL”), which was the only circumstance in which it was permissible to obtain a second covid support loan, in that: Under the BBL scheme a qualifying business that was established before 01 January 2019 was able to apply for a loan of up to 25% of its turnover in the 2019 calendar year, up to a maximum of £50,000; It was a condition of the BBL scheme that a borrower could only apply for one BBL or CBIL unless it used a subsequent BBL or CBIL to repay an existing BBL or CBIL in full; On 03 October 2020 Mr Whetlor obtained a CBIL of £50,001 for CJWC; On 09 October 2020 Mr Whetlor applied for and obtained a BBL of £50,000 for CJWC completing a declaration that the company had not yet obtained, nor was in the process of applying for, a loan through the Coronavirus Business Interruption Loan Scheme unless those facilities were to be refinanced in full by the BBL The BBL was not used to repay the CBIL and both remained outstanding in full when CJWC went into liquidation on 18 March 2021.
