Notice is hereby given that Creag Riabhach Wind Farm Ltd,
company registration number SC424471, with its registered office at 2
Castle Terrace, 4th Floor, Edinburgh, Scotland, Scotland, EH1 2EL,
has applied to the Scottish Ministers under section 36C of the
Electricity Act 1989 to vary the section 36 consent to construct and
operate the Creag Riabhach Wind Farm at the Altnaharra Estate,
Sutherland (Central Grid Reference NC 52792 28639 previously
consented on 17 October 2016 by Scottish Ministers (“the variation
application”). The application also requests that a direction be made
by the Scottish Ministers under section 57 of the Town and Country
Planning (Scotland) Act 1997 that planning permission is deemed to
be varied.
The variation application seeks to make the following variations: To
vary Condition 1 of the Section 36 Consent to extend the
operational period of the Creag Riabhach Wind Farm to a period
of 40 years from the Date of Final Commissioning. The
application also seeks a direction to vary the deemed planning
permission Condition 22 (to extend the duration of the consent
from 25 to 40 years) and Condition 23 (to extend the time period
to 40 years from the Date of Final Commissioning for the site
decommissioning, restoration and aftercare to apply).

THE ELECTRICITY WORKS (ENVIRONMENTAL IMPACT
ASSESSMENT) (SCOTLAND) REGULATIONS 2017
Notice is hereby given that Creag Riabhach Wind Farm Limited,
company registration number SC424471, with its Registered Office at
2 Castle Terrace, 4th Floor, Edinburgh, Scotland, EH1 2EL, has
applied to the Scottish Ministers for consent under Section 36 of the
Electricity Act 1989 to construct and operate, for a period of up to 40
years, a renewable energy development, known as Creag Riabhach
Wind Farm Extension, on land in the ownership of Altnaharra Estate
immediately adjacent to the east and partly within Creag Riabhach
Wind Farm. The application site is located approximately 6.5 km
south of the settlement of Altnaharra on the A836 and approximately
21.5 km north of the village of Lairg in central Sutherland (central grid
reference NGR NC 52978 27588). The proposed development is an
extension to Creag Riabhach Wind Farm, comprises a three-turbine
extension (each turbine would have a ground to blade tip height of up
to 149.9m), battery energy storage system (BESS) and associated
infrastructure. The candidate extension turbines would have an
indicative capacity of 12.6MW and the BESS would have an indicative
capacity of 37.3MW. Therefore, the total installed capacity of the
proposed development in conjunction with the existing Creag
Riabhach Wind Farm would be greater than 50 MW. The proposed
development is subject to Environmental Impact Assessment (EIA)
and an EIA Report has been produced to accompany the application
for consent.
Creag Riabhach Wind Farm Limited has also applied for a direction
under Section 57(2) of the Town and Country Planning (Scotland) Act
1997 that planning permission for the development be deemed to be
granted.

ENVIRONMENTAL IMPACT ASSESSMENT
DETERMINATION UNDER SECTION 55A OF THE ROADS
(SCOTLAND) ACT 1984
The Scottish Ministers give notice that they have determined that the
project for resurfacing works on the east bound carriageway of the
M8, to the south of Broxburn is a relevant project within the meaning
of section 55A of the Roads (Scotland) Act 1984 (“the 1984 Act”) and
falls within Annex II of Directive 2011/92/EU on the assessment of
certain public and private projects on the environment, but that having
regard to –
(a) the selection criteria contained in Annex III of that Directive, namely
(i) the use of natural resources, in particular land, soil, water and
biodiversity;
(ii) the production of waste;
(iii) pollution and nuisances;
(iv) the risks to human health (for example due to water contamination
or air pollution);
(v) landscapes and sites of historical, cultural or archaeological
significance
(vi) nature reserves and parks,
(b) the results of the Environmental Screening Assessment under
section 55A(2) of the 1984 Act,
(c) the information set out in the Record of Determination dated 15
May 2023, available at https://www.transport.gov.scot/transport-
network/roads/road-orders-and-records-of-determination/#63527, the
project does not require an Environmental Impact Assessment.
The main reasons for the conclusion that no Environmental Impact
Assessment is required are:
(a) Consultation with Historic Environment Scotland has determined
that the works will not impact any area of the scheduled monument,
therefore no scheduled monument consent is required;
(b) The scheme is not situated within, and does not share connectivity
with a sensitive area designated for biodiversity features; and
(c) The scheme will be confined within the existing carriageway
boundaries.
The features of the project which are envisaged to avoid or prevent
significant adverse effects on the environment are:
(a) Mitigation measures and best practice will be implemented to
ensure no short-term or long-term significant negative impacts on the
environment;
(b) Containment measures of the working area will be in place to
prevent debris or pollutants from entering the surrounding
environment; and
(c) Measures will be in place to ensure appropriate removal and
disposal of waste.

The Scottish Ministers give notice that they have determined that the
project for undertaking scour repair works on the Millennium Foot
Bridges on the A9 is a relevant project within the meaning of section
55A of the Roads (Scotland) Act 1984 (“the 1984 Act”) and falls within
Annex II of Directive 2011/92/EU on the assessment of certain public
and private projects on the environment, but that having regard to –
(a) the selection criteria contained in Annex III of that Directive, namely
(i) the use of natural resources, in particular land, soil, water and
biodiversity;
(ii) the production of waste;
(iii) pollution and nuisances;
(iv) the risks to human health (for example due to water contamination
or air pollution);
(v) areas classified or protected under national legislation; Natura
2000 areas designated by Member States pursuant to Directive
92/43/EEC and Directive 2009/147/EC
(vi) nature reserves and parks,
(b) the results of the Environmental Screening Assessment under
section 55A(2) of the 1984 Act and the Assessment under regulation
48 of the Conservation (Natural Habitats, &c.) Regulations 1994 (“the
1994 Regulations”) concluded that there would be no likely significant
effects on the River Spey Special Area of Conservation, Drumochter
Hills Special Area of Conservation, Drumochter Hills Special
Protection Area and the Drumochter Hills Site of Special Scientific
Interest,
(c) the information set out in the Record of Determination dated 19
April 2023, available at https://www.transport.gov.scot/transport-
network/roads/road-orders-and-records-of-determination/#63527, the
project does not require an Environmental Impact Assessment.
The main reasons for the conclusion that no Environmental Impact
Assessment is required are:
(a) The Assessment under the 1994 Regulations has concluded that
there will be no likely significant effects on the River Spey Special
Area of Conservation, Drumochter Hills Special Area of Conservation,
Drumochter Hills Special Protection Area and the Drumochter Hills
Site of Special Scientific Interest;
(b) Works will not result in any residual visual change, and as such will
have no change to the special qualities for which the Cairngorms
National Park is designated; and
(c) The scheme will be confined within the existing carriageway
boundaries.
The features of the project which are envisaged to avoid or prevent
significant adverse effects on the environment are:

Existing Strip of carriageway on the access road to the south of

The development
The application is for a part outline and part detailed planning
permission for the following proposed development:
(a) Phased demolition of all existing buildings;
(b) Mixed use phased development comprising residential up to 2550
units (mix tenure including social rent, affordable rent, intermediate,
private rented and private sale) ranging from 3 - 31 storeys above
ground level including leisure centre, health, flexible commercial uses
(retail, financial and professional services, café / restaurants, drinking
establishments, hot-food takeaways, business, non-residential
institutions and assembly and leisure), park, landscaping, public
realm, energy centres, car/cycle parking and new vehicle accesses.
All matters reserved except for phased construction of Block 1 (two
residential towers comprising 239 private sale units and new leisure/
community centre of 12,400sqm GIA including a gym, swimming pool
and library, commercial uses of 2191sqm GIA), Block 5 (comprising
136 affordable units and commercial units of 393sqm GIA) and Block
6 (64 private sale units and 63 affordable units) together with a new
Park (2.49ha) and associated works; and
(c) Site clearance and enabling works including works to Winstanley
Road, as well as temporary works necessary to enable the approved

As directed by regulation 23(4) of the Electricity Works (Environmental
Impact Assessment) (Scotland) 2017, notice is hereby given that
Creag Riabhach Wind Farm Limited, a company incorporated under
the Companies Act with company number SC424471 and having its
registered office at 2 Castle Terrace, 4th Floor, Edinburgh, Scotland,
EH1 2DP has been granted consent under section 36 of the Electricity
Act 1989 by the Scottish Ministers to construct and operate the Creag
Riabhach Wind Farm Extension.
The Creag Riabhach Wind Farm Extension (two turbines with a blade
tip height not exceeding 149.9 metres and Battery Energy Storage
System) will be located 6.5 km south of the settlement of Altnaharra
on the A836 and approximately 21.5 km north of the village of Lairg in
central Sutherland within the planning authority area of The Highland
Council.
The Scottish Ministers have also directed, under Section 57 (2) of the
Town & Country Planning Act (Scotland) 1997, that planning
permission is deemed to be granted.

west bound carriageway and on-slip, to the west of Harthill is a
relevant project within the meaning of section 55A of the Roads
(Scotland) Act 1984 (“the 1984 Act”) as the works fall within Annex II
of Directive 2011/92/EU on the assessment of certain public and
private projects on the environment, but that having regard to –
(a) the selection criteria contained in Annex III of that Directive, namely
(i) the use of natural resources, in particular land, soil, water and
biodiversity;
(ii) the production of waste;
(iii) pollution and nuisances;
(iv) the risks to human health (for example due to water contamination
or air pollution),
