Alison Carol Irani failed to ensure that Datastar Networks Limited (“Datastar”) met its financial commitments to HM Revenue and Customs (“HMRC”) in respect of Corporation Tax (“CT”) for the years ending 02/2011 until 02/2018, and caused Datastar to trade to the detriment of HMRC from at the latest November 2016 to liquidation. As a result, at the date of liquidation, Datastar owed £81,444.15 in CT based on returns. A further £8,729.69 is owed in interest and penalties making a total of £89,973.84 due. • For the year ended 02/2011 a return was submitted for £9,9429.84 and made payment of £9.073.91 leaving an outstanding balance of £355.93; • In subsequent years, years ending 02/2012 to 02/2018, returns were submitted totalling £82,335.30 while payments totalling £1,247.08 were made and were not sufficient to clear the liability in full; • Ms Irani made arrangements with HMRC to settle the outstanding liability via a time to pay agreement prior to February 2016. Six payments of £1,500 were made between March and August 2016, but the agreement was cancelled as it was not adhered to; • Ms Irani set up but failed to adhere to two further time to pay agreements. No payments were made under these agreements; • Bank statements for the period November 2016 to 3 July 2019, the date of liquidation show that £155,657.40 was paid into the account. Ms Irani received £149,762.68. All other payments were made to classes of creditors other than HMRC. Ms Irani’s conduct has resulted in an outstanding liability to HMRC in respect of CT of £89,973.84. HMRC was the majority creditor at liquidation.
