Between 1 June and 27 November 2017, Shirley Evadna Wilson (“Miss Wilson”) transferred sums totalling £36,247 from the bank account of Doman-Wilson Management Solutions Limited (“Doman”) to a bank account in her own name which materially contributed to the company’s insolvency. These transactions were to the detriment of the company’s creditors, in particular HM Revenue & Customs (“HMRC”). In that:- Insolvency
While Doman’s unaudited financial statements for the year to 31 January 2017 disclose a net asset position of £3,910, the company’s only asset was an overdrawn director’s loan account of £49,225, which remained unpaid at the date of liquidation;
HMRC are the only creditor to have submitted a claim in the liquidation, with a total claim of £49,932;
The earliest unpaid VAT liability relates to the return for the quarter ended 31 October 2015, which fell due for payment on 07 December 2015;
The earliest unpaid Corporation Tax liability relates to the return for the year ended 31 January 2015, which fell due for payment on 1 November 2015; Transactions
As at 31 May 2017, Doman’s bank account was overdrawn in the sum of £2,402, its VAT debt was £10,585 and its Corporation Tax debt was £28,189;
Between 1 June and 27 November 2017 Doman received payments from a client totalling £40,600, of which £36,247 was paid into a bank account in the name of Director with only £1,000 paid towards Doman’s outstanding HMRC debt.
