The Outgoing Officeholder is released from liability pursuant to the relevant sections of the Insolvency Act 1986 in relation to his conduct as office-holder of the companies as are listed in the Schedules of Cases below from 56 days after filing notice of his removal with the Registrar of Companies or the giving of notice to creditors of the relevant estate in accordance with this Order, save that such release may be subject to further order in the event of an application by any creditor / member referred to below for the specific case subject to that application. Any creditor (or in the case of any members’ voluntary liquidations, any member) and/or debtors (where they have a financial interest in the outcome of the insolvency proceedings) in respect of any of the companies listed in the Schedules of Cases below who has an objection to this Order, and/or in respect of Outgoing Officeholder’s release, shall have 56 days from the date of the advertisement to apply to the Court to set aside or vary this Order. Such application shall not affect the transfer of that specific case until further or other order by the Court. In the cases of each liquidation, the costs of complying with a request of the committee or creditor for an account of the Outgoing Officeholder’s administration of the relevant estate should be an expense of the insolvency proceedings. The text of the Double Taxation Agreement has been published as the Schedule to the Double Taxation Relief and International Tax Enforcement (Gibraltar) Order 2020 (Statutory Instrument 2020 No. 275), copies of which can be obtained from The Stationery Office. The text of the Order can also be accessed on the Internet at http://www.legislation.gov.uk/. The provisions of the Double Taxation Agreement take effect in the UK from 1 May 2020 for taxes withheld at source (including PAYE on employment income), 1 April 2020 for corporation tax and from 6 April 2020 for income and capital gains tax, and in Gibraltar the provisions apply from 1 May 2020 for taxes withheld at source and from 1 July 2020 for income and corporation taxes. The provisions of Article 25 (Exchange of Information) and Article 26 (Assistance in the collection of taxes) of the Agreement have effect in both the UK and Gibraltar from the entry into force date of the Agreement, without regard to the taxable period to which the matter relates.
