Improper conduct which resulted in their disqualification
Mr Jetmir Marku (“Mr Marku”) failed to ensure that JMGB Solution Ltd (hereinafter referred to as “JMGB”) maintained proper accounting records, or in the alternative, failed to preserve and deliver up to the Liquidator such records as were maintained for the period 01 May 2018 to 08 June 2021. As a result, it has not been possible to ascertain or verify: • The eligibility of the company for a Bounce Back Loan (“BBL”). Mr Marku stated that the company operated until September 2020 but the last income into the bank account is in April 2020. Companies had to be trading or engaged in business activity on the date of the BBL application. The company applied for a BBL on 02 July 2020. • The true level of turnover for 2019 and whether the turnover submitted on the BBL application form was accurate. The company received income of £152,332.79 in 2019 and declared a turnover of £203,000 on the BBL application form. This may mean the company overstated its turnover to obtain government backed BBL funds that the company in excess of what it was eligible for. • The VAT liability of the company. Mr Marku failed to submit VAT returns after VAT period 01/18, despite the company being operational and receiving income up until 17 April 2020. • The Corporation tax liability of the company. The last Corporation Tax return submitted to HMRC was for period 30 April 2018. Additionally, the company has failed to pay the CT liability of £18,220.66 for FYE 30 April 2017.
