- Gideon Seshie Affleck (“Mr Affleck”) caused Kando Security Limited (“Kando”) to breach the terms & conditions of the Bounce Back Loan (“BBL”) scheme by applying for a BBL of £50,000 to which it was not entitled. Consequently, Kando received more monies than it was entitled to from the BBL scheme and thereafter the BBL monies were not used for the economic benefit of the business, in that: • The Bounce Back Loan (“BBL”) criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover for the 2019 calendar year. If the business was established after 01 January 2019, a director should apply the 25% limit to the estimated annual turnover from the date the business started business. • The eligibility criteria included that a business was established and actively trading at 01 March 2020. • Kando was incorporated on 23 January 2020. • Accounts for the year ending 31 January 2021 show the company to be dormant. • The company bank account shows the first transaction on the company bank account was dated 24 July 2020. • In the BBL application form completed on 19 July 2020 the estimated turnover was stated to be £218,000. • The BBL of £50,000 was paid into the company bank account on 06 October 2020. • A review of the company bank account following the receipt of the BBL monies shows between 06 October 2020 and 13 October 2020 transfers totalling £50,000 were made to Mr Affleck for which there is no evidence that they were for the benefit of the company. • Kando entered liquidation on 02 November 2022 with liabilities of £47,001 of which £45,000 is in respect of the outstanding BBL.
