Notice is hereby given that Kellas Drum Limited, company registration
number SC742116 with its Registered Office at c/o Turcan Connell,
Princes Exchange, 1 Earl Grey Street, Edinburgh, EH3 9EE, has
applied to the Scottish Ministers for consent under Section 36 of the
Electricity Act 1989 to construct and operate a wind farm known as
Kellas Drum Wind Farm (“the Proposed Development”), located
approximately 11km southwest of Elgin and 4.5km east of Dallas,
IV30 8TS, within the planning area of Moray, (Central Grid Reference
Easting 317800, Northing 852413). It will have a generating capacity
exceeding 50MW. The Proposed Development is subject to an
Environmental Impact Assessment (EIA). An EIA Report has been
produced to accompany the application for consent.
Kellas Drum Limited has also applied for a direction under Section
57(2) of the Town and Country Planning (Scotland) Act 1997 that
planning permission for the proposed Development be deemed to be
granted.
Kellas Drum Limited has now submitted Additional Information to the
Scottish Ministers, which includes an Addendum to the EIA Report as
a result of assessing changes made to the original proposal. These
changes are to address an objection raised by the Moray Council and
a now resolved objection from SEPA. The proposed changes include
a reduction of all 8 turbines from 6 at 185m and 2 at 175m ground to
tip height to 8 at 149.9m ground to tip height, addition of riparian
planting, updates to the B9010 road mitigation plan, analysis of
ancient woodland on the delivery route, the inclusion of an alternative
delivery route via Miltonduff and a minor change to the proposed
track and crane pad to Turbine 8. The amended installed capacity of
the generating station would be 68.4MW which includes 30MW of
energy storage.

As a result of a statutory objection from the relevant planning
authority, or where the Scottish Ministers decide to exercise their

Inquiry to be held.

DIRECTION BY THE SCOTTISH MINISTERS TO THE SCOTTISH
ENVIRONMENT PROTECTION AGENCY (SEPA)
The Scottish Ministers, in exercise of the powers conferred by
sections 35(7) and 37(3) of the Environmental Protection Act 1990 (the
“1990 Act”) and regulation 60 of the Pollution Prevention and Control
(Scotland) Regulations 2012 (the “2012 Regulations”), have issued a

The Scottish Ministers give notice that they have determined that the
project to undertake resurfacing works on the A720 to the south west
of Swanston, Edinburgh is a relevant project within the meaning of
section AI of the Roads (Scotland) Act 1984 (“the 1984 Act”) as the
works fall within Annex II of Directive 2011/92/EU on the assessment
of certain public and private projects on the environment, but that
having regard to –
(a) the selection criteria contained in Annex III of that Directive, namely

short-term, non-significant, and limited to the construction phase.
The features of the project which are envisaged to avoid or prevent
significant adverse effects on the environment are:
(a) Mitigation measures and best practice will be implemented to
ensure no short-term or long-term significant negative impacts on the
environment;
(b) Containment measures of the working area will be in place to
prevent debris or pollutants from entering the surrounding
environment; and
(c) Measures will be in place to ensure appropriate removal and
disposal of waste.

THE A122 LOWER THAMES CROSSING DEVELOPMENT
CONSENT ORDER 2025
NOTICE OF AUTHORISATION OF COMPULSORY ACQUISITION
The above Order, made under the Planning Act 2008 by the Secretary
of State for Transport and published on 25th March 2025, includes
provision authorising the compulsory acquisition of land, existing
rights over land, and of rights over land by creating new rights over it
and imposing restrictive covenants as described in Schedule 1 and
more particularly described in the Order.
The Order includes provision authorising the acquisition for the
purpose of the A122 Lower Thames Crossing Project located within
ten administrative areas: Brentwood Borough Council, Dartford
Borough Council, Essex County Council, Gravesham Borough
Council, Kent County Council, London Borough of Havering,
Maidstone Borough Council, Medway Council, Thurrock Council and
Tonbridge and Malling Borough Council. The Project will provide a
new road connection between the A2 and M2 in Kent, east of
Gravesend, crossing under the River Thames through two bored
tunnels, and joining the M25 south of junction 29, as set out in the
plans which accompanied the application for development consent

A person aggrieved by the Order may challenge the Order only in
accordance with section 118 of the Planning Act 2008, which

later, the day on which the statement of reasons for making the Order
was published).
Once the provision in the Order authorising compulsory acquisition
comes into force National Highways Limited may acquire any of the
land (including any existing rights and/or new rights) described in
Schedule 1 below by executing a general vesting declaration under
section 4 of the Compulsory Purchase (Vesting Declarations) Act
1981. A statement on the effect of Parts 2 and 3 of that Act is set out
in Schedule 2.
Any person who would be entitled to claim compensation if a general
vesting declaration were executed is invited to give National
Highways Limited information about the person’s name, address, and
interest in land, using a prescribed form. The prescribed form is set
out in Schedule 3 below.

Description of the land, existing rights and the new rights
The Order land (as defined in Article 2 of the Order) is shown on the
land plans (as defined in Article 2 of the Order) and described in the
deposited book of reference (as defined in Article 2 of the Order)
located within ten administrative areas: Brentwood Borough Council,
Dartford Borough Council, Essex County Council, Gravesham
Borough Council, Kent County Council, London Borough of Havering,
Maidstone Borough Council, Medway Council, Thurrock Council and
Tonbridge and Malling Borough Council.
This notice relates to so much of the Order land as is shown on the
land plans accompanying the Order:
• shaded pink – compulsory acquisition of all interests and rights in
land, including as required, subsoil, surface land or airspace;
• shaded blue – creation and compulsory acquisition of new rights,
including where necessary, a right to impose restrictive covenants;
• shaded yellow – compulsory acquisition of subsoil together with the
creation and compulsory acquisition of new rights, including, where
necessary, a right to impose restrictive covenants above that subsoil;

The main powers authorising the compulsory acquisition of land, or
interests in, or rights over land, are contained in Articles 25
(Compulsory acquisition of land) and 28 (Compulsory acquisition of
rights and imposition of restrictive covenants) of the Order. Article 29
(Private rights over land) provides for the extinguishment of all existing
private rights over land. Article 33 (Acquisition of subsoil or airspace
only) permits National Highways Limited to choose instead to acquire
only the subsoil underneath or the airspace over the land.

set out in Schedule 8 and 10 to the Order.
SCHEDULE 2
Statement on the effect of Parts 2 and 3 of the Compulsory
Purchase (Vesting Declarations) Act 1981
Power to execute a general vesting declaration
1. Once the provision in The A122 (Lower Thames Crossing)
Development Consent Order 2025 which authorises compulsory
acquisition comes into force, the acquiring authority (hereinafter called
National Highways) may acquire any of the land (including any
existing rights and / or new rights) described in Schedule 1 above by
executing a general vesting declaration under section 4 of the
Compulsory Purchase (Vesting Declarations) Act 1981 (“the Act”). This
has the effect, subject to paragraphs 3 and 5 below, of vesting the
land in National Highways at the end of the period mentioned in
paragraph 2 below.
Notices concerning general vesting declaration.
2. As soon as may be after National Highways execute a general
vesting declaration, they must serve notice of it on every occupier of
any of the land specified in the declaration (except land where there is
one of the tenancies described in paragraph 4) and on every person
who gives them information relating to the land in pursuance of the
invitation contained in the notice of the authorisation of compulsory
acquisition. When the service of notices of the general vesting
declaration is completed, a period specified in the declaration, of not
less than three months, will begin to run. On the first day after the end
of this period the land described in the declaration will, subject to
what is said in paragraphs 3 and 5, vest in National Highways
together with the right to enter on the land and take possession of it.
Every person on whom National Highways could have served a notice
to treat in respect of their interest in the land (other than a tenant
under one of the tenancies described in paragraph 4) will be entitled
to claim compensation for the acquisition of their interest in the land,
with interest on the compensation from the vesting date.
3. The “vesting date” for any land specified in the declaration will be
the first day after the end of the period mentioned in paragraph 2
above, unless a counter-notice is served under Schedule A1 to the
Act within that period. In such circumstances, the vesting date for the
land which is the subject of the counter-notice will be determined in
accordance with Schedule A1.
Modifications with respect to certain tenancies
4. In the case of certain tenancies, the position stated above is
subject to modifications. The modifications apply where the tenancy
is either a “minor tenancy”, i.e. a tenancy for a year or a yearly
tenancy or a lesser interest, or “a long tenancy which is about to
expire”. The latter expression means a tenancy granted for an interest
greater than a minor tenancy but having on the vesting date a period
still to run which is not more than the period specified in the
declaration for this purpose (which must be more than a year). In
calculating how long a tenancy has still to run, where any option to
renew or to terminate it is available to either party, it shall be assumed
that the landlord will take every opportunity open to him to terminate
the tenancy while the tenant will use every opportunity to retain or
renew their interest.
5. The modifications are that National Highways may not exercise the
right of entry referred to in paragraph 2 in respect of land subject to a
tenancy described in paragraph 4 unless they first serve notice to
treat in respect of the tenancy and then serve every occupier of the
land with a notice of their intention to enter and take possession after
the period (not less than three months from the service of the notice)
specified in the notice. The right of entry will be exercisable at the end
of that period. The vesting of the land will be subject to the tenancy
until the end of that period or until the tenancy comes to an end,
whichever happens first.
