Mr Leigh Gerard Shufflebotham (“Mr Shufflebotham”) failed to ensure that Kingsland Home Improvements Ltd (“Kingsland”) maintained and/or preserved adequate accounting records, or in the alternative, he failed to deliver up to the Liquidator such records as were maintained and/or preserved. As a result, it has not been possible to: 1)Deduce in the absence of sales records, the current financial position with regard to Kingsland’s main customer. The statement of affairs in the liquidation, signed by Mr Shufflebotham on 20 February 2018, discloses that £70,000 remained outstanding from this customer. On 4 January 2019 the Liquidator wrote to Kingsland’s main customer requesting proposals for the repayment of the amount of £78,106. The customer has stated that rather than owing Kingsland the sum of £78,106, Kingsland owes them £ 18,140. Without the relevant records the Liquidator has been unable to establish the true position or make any recovery for the benefit of Kingsland’s creditors. 2) Deduce, without adequate sales records whether £157,217 paid into its bank account, between 24 February 2017 and 15 September 2017, constituted the full extent of Kingsland’s sales income in that period.. In the absence of adequate sales records it is not possible to determine if there were any other book debts 3) Deduce, without adequate purchase records, whether transactions totalling £141,443 paid out of Kingslands bank account, between 20 February 2017 and 02 October 2017, relate to bona fide company expenditure.
