ENVIRONMENTAL IMPACT ASSESSMENT
DETERMINATION UNDER SECTION 55A OF THE ROADS
(SCOTLAND) ACT 1984
The Scottish Ministers give notice that they have determined that the
project to undertake resurfacing works on the A75 from Auchenlarie to
Ravenshall, Dumfries and Galloway is a relevant project within the
meaning of section 55A of the Roads (Scotland) Act 1984 (“the 1984
Act”) as the works fall within Annex II of Directive 2011/92/EU on the
assessment of certain public and private projects on the environment,
but that having regard to –
(a) the selection criteria contained in Annex III of that Directive, namely
(i) the use of natural resources, in particular land, soil, water and
biodiversity;
(ii) the production of waste;
(iii) pollution and nuisances;
(iv) the risks to human health (for example due to water contamination
or air pollution);
(v) areas classified or protected under national legislation; Natura
2000 areas designated by Member States pursuant to Directive
92/43/EEC and Directive 2009/147/E,
(b) the results of the Environmental Screening Assessment under
section 55A(2) of the 1984 Act and the Assessment under regulation
48 of the Conservation (Natural Habitats, &c.) Regulations 1994 (“the
1994 Regulations”) concluded that there would be no likely significant
effects on the Solway Firth Special Protection Area,
(c) the information set out in the Record of Determination dated 9 July
2024, available at https://www.transport.gov.scot/transport-network/
roads/road-orders-and-records-of-determination/#63527, the project
does not require an Environmental Impact Assessment.
The main reasons for the conclusion that no Environmental Impact
Assessment is required are:
(a) The works will not impact the special qualities of the Ravenshall
Wood Site of Special Scientific Interest;
(b) The Assessment under the 1994 Regulations concluded that there
would be no likely significant effects on the Solway Firth Special
Protection Area; and
(c) Any potential impacts of the works are expected to be temporary,
short-term, non-significant, and limited to the construction phase.
The features of the project which are envisaged to avoid or prevent
significant adverse effects on the environment are:
(a) Mitigation measures and best practice will be implemented to
ensure no short-term or long-term significant negative impacts on the
environment;
(b) Containment measures of the working area will be in place to
prevent debris or pollutants from entering the surrounding
environment; and
(c) Measures will be in place to ensure appropriate removal and
disposal of waste.

Notice is hereby given that an application has been made by Rosyth
Royal Dockyard Ltd to the Scottish Environment Protection Agency
(SEPA) for a variation to an existing Permit which allows the disposal
radioactive waste from the Rosyth Royal Dockyard.
SEPA is holding a consultation on this application and invites views
on what is being proposed.
The consultation is available on the SEPA website at https://
consultation.sepa.org.uk/permits/ until 31 October 2024 and any
responses received before then will be considered by SEPA when
determining the application. Comments are invited on the
understanding that they may be made public by SEPA. Comments will

A82 ARDLUI TO INVERUGLAS
ENVIRONMENTAL IMPACT ASSESSMENT
DETERMINATION UNDER SECTION 55A OF THE ROADS

trunk road between Ardlui and Inveruglas is a relevant project within
the meaning of section 55A of the Roads (Scotland) Act 1984 (“the
1984 Act”) as the works fall within Annex II of Directive 2011/92/EU on
the assessment of certain public and private projects on the
environment, but that having regard to –
(a) the selection criteria contained in Annex III of that Directive, namely
(i) the use of natural resources, in particular land, soil, water and
biodiversity;
(ii) the production of waste;
(iii) pollution and nuisances;
(iv) the risks to human health (for example due to water contamination
or air pollution);
(v) areas classified or protected under national legislation; Natura
2000 areas designated by Member States pursuant to Directive
92/43/EEC and Directive 2009/147/E;
(vi) landscapes and sites of historical, cultural or archaeological
significance,
(b) the results of the Environmental Screening Assessment under
section 55A(2) of the 1984 Act and the Assessment under regulation
48 of the Conservation (Natural Habitats, &c.) Regulations 1994 (“the
1994 Regulations”) concluded that there would be no likely significant
effects on the Loch Lomond Woods Special Area of Conservation,
and the Glen Etive and Glen Fyne Special Protection Area,
(c) the information set out in the Record of Determination dated 4

#63527, the project does not require an Environmental Impact
Assessment.
The main reasons for the conclusion that no Environmental Impact
Assessment is required are:
(a) The works will not impact the Category C Listed Building ‘Sloy
Power Station, Bridge’, the Loch Lomond and Trossachs National
Park, and the Loch Lomond National Scenic Area;
(b) The Assessment under the 1994 Regulations concluded that there
would be no likely significant effects on the Loch Lomond Woods
Special Area of Conservation, and the Glen Etive and Glen Fyne
Special Protection Area;
(c) The works will be confined within the existing carriageway
boundaries and as a result will not require any land take and will not
alter any local land uses; and
(d) Any potential impacts of the works are expected to be temporary,
short-term, non-significant, and limited to the construction phase.
The features of the project which are envisaged to avoid or prevent
significant adverse effects on the environment are:
(a) Mitigation measures and best practice will be implemented to
ensure no short-term or long-term significant negative impacts on the
environment;
(b) Containment measures of the working area will be in place to
prevent debris or pollutants from entering the surrounding
environment; and
(c) Measures will be in place to ensure appropriate removal and
disposal of waste.

project for undertaking drainage improvement works on the M90
Friarton Bridge is a relevant project within the meaning of section 55A
of the Roads (Scotland) Act 1984 (“the 1984 Act”) and falls within
Annex II of Directive 2011/92/EU on the assessment of certain public
and private projects on the environment, but that having regard to –
(a) the selection criteria contained in Annex III of that Directive, namely
(i) the use of natural resources, in particular land, soil, water and
biodiversity;
(ii) the production of waste;
(iii) pollution and nuisances;
(iv) the risks to human health (for example due to water contamination
or air pollution);
(v) areas classified or protected under national legislation; Natura
2000 areas designated by Member States pursuant to Directive
92/43/EEC and Directive 2009/147/EC,
(b) the results of the Environmental Screening Assessment under
section 55A(2) of the 1984 Act and the Assessment under regulation

to Easterton, north of Denny is a relevant project within the meaning
of section 55A of the Roads (Scotland) Act 1984 (“the 1984 Act”) as
the works fall within Annex II of Directive 2011/92/EU on the
assessment of certain public and private projects on the environment,
but that having regard to –
(a) the selection criteria contained in Annex III of that Directive, namely
(i) the use of natural resources, in particular land, soil, water and
biodiversity;
(ii) the production of waste;
(iii) pollution and nuisances;
(iv) the risks to human health (for example due to water contamination
or air pollution),
(b) the results of the Environmental Screening Assessment under
section 55A(2) of the 1984 Act,
(c) the information set out in the Record of Determination dated 9
August 2024, available at https://www.transport.gov.scot/transport-

project does not require an Environmental Impact Assessment.

(c) Any potential impacts of the works are expected to be temporary,

ensure no short-term or long-term significant negative impacts on the
environment;

NOTICE UNDER REGULATION 21
The proposed development at Overhill Wind Farm, B741 from Armour
Wynd to U720 Dalricket, Dalmellington is subject to environmental
impact assessment under the Town and Country Planning
(Environmental Impact Assessment) (Scotland) Regulations 2017.
Notice is hereby given that an EIA report has been submitted to East
Ayrshire Council by Mr Michael Briggs, Energiekontor UK Ltd relating
to the planning application in respect of planning application under
Section 42 of the Town and Country Planning (Scotland) Act 1997 to
vary conditions 1, 3, 6, 7, 9, 10 and 11 of planning permission
20/0425/PP to allow the relocation and enlargement of the on-site
substation and the extension of the operational life of the wind farm
from 25 to 35 years.
Possible decisions relating to the application are:-
i) approval of the application without conditions;
ii) approval of the application with conditions;
iii) refusal of the application.

The Secretary of State gives notice of an Order made under Section
247 of the above Act entitled "The Stopping up of Highway (North
East) (No.23) Order 2024" authorising the stopping up of a southern
part width of Armstrong Road at Newcastle in the City of Newcastle.
This is to enable development as permitted by Newcastle City
Council, under reference 2007/1300/84/RES.
Copies of the Order may be obtained, free of charge, from the

DEVELOPMENT CONSENT ORDER FOR THE MAEN HIR SOLAR
FARM AND ENERGY STORAGE PROJECT
Notice is hereby given that Lightsource SPV 204 Limited (company
number 08943830) of 7th Floor 33 Holborn, London, United Kingdom,
EC1N 2HU (“the Applicant”) proposes to make an application (“the
Application”) to the Secretary of State for Energy Security and Net
Zero under Section 37 of the Planning Act 2008 (as amended) for a
development consent order (“DCO”) in respect of Prosiect Maen Hir
(“the Project”).
The Project comprises the construction, operation and maintenance
and decommissioning of a solar electricity generating station with a
capacity of over 350 MW (megawatts) alternating current (AC),
associated development including a battery energy storage system, a
community solar project, project substation and ancillary
infrastructure. The Project will be connecting to a new National Grid
Electricity Transmission Substation, which is anticipated to be
consented separately by National Grid Electricity Transmission plc.
The Project comprises three linked parcels, being located in the area
near Rhosgoch and Bodewryd (known as “Maen Hir North”), around
the northern and eastern periphery of Llyn Alaw (known as “Maen Hir
Central”) and to the north-east and south-east of Llannerch-y-medd
(known as “Maen Hir South A and B”), with a grid connection corridor
connecting these parcels in north Anglesey, within the administrative
area of the Isle of Anglesey County Council.
Because the Project has an anticipated generation capacity which
exceeds 350MW it is classified as a Nationally Significant
Infrastructure Project (NSIP) under the Planning Act 2008. The
proposed DCO will, among other things, authorise:
• construction, operation and decommissioning of a ground mounted
solar PV electricity generating facility;
• associated development and ancillary works including the
construction of a BESS; substations, cabling to connect to the Project
Substation, cabling to connect to a new National Grid Substation;
Community Solar Project; the creation of environmental mitigation and
enhancement areas; permissive paths; access tracks; construction
compounds;
• alterations to streets, including the creation and modification of
temporary and permanent accesses, the temporary removal of street
furniture, improvements to public rights of way and any necessary
temporary diversion and/or temporary closures up of public rights of
way;
• the permanent compulsory acquisition and temporary possession of
land and/or rights;
• the overriding of easements and other rights over or affecting land
as well as the creation of restrictions where necessary;
• the application and/or disapplication of legislation including,
amongst other things, legislation relating to compulsory purchase and
landlord and tenant matters; and
• such ancillary, incidental and consequential provisions, licenses,
property rights, permits and consents as are necessary and/or
convenient for the purposes of the Project.
The Project is an Environmental Impact Assessment (EIA)
development for the purposes of the Infrastructure Planning
(Environmental Impact Assessment) Regulations 2017. As a result, the
Applicant is required to carry out an EIA and submit an Environmental
Statement (ES) as part of the Application.
The ES will provide a detailed description of the Project and
information about its likely significant effects on the environment.
Information currently available about the preliminary likely significant
environmental effects of the Project is set out in the Preliminary
Environmental Information Report (PEIR) and summarised in a non-
technical summary (PEIR NTS) that forms part of the consultation
material.

Consultation on the Project will take place from 02 October 2024 to
23:59 on 15 November 2024 (“the Consultation Period”).
