Mark Weaver (“Mr Weaver”) failed to ensure that MARK WEAVER CMMS SERVICES LIMITED (“Mark Weaver CMMS’ )met its financial commitments as regards to Corporation Tax (“CT”), National Insurance Contributions (“NIC”) and Value Added Tax (“VAT”) and caused the company to continue trading whilst withdrawing funds for the benefit of himself. As a result Mark Weaver CMMS became unable to meet its financial commitments to HMRC as and when they became due, at the latest, from December 2014. In that: • A VAT liability was incurred for the period 12/2014 to 06/2018 of £38,597. Surcharges have been incurred increasing the VAT debt to £43,870. • Corporation Tax is outstanding for the years 2014 to 2017. Penalties and accrued interest were added to the liability resulting in a total Corporation Tax liability of £61,490. • Class 1 and Class 1A National Insurance Contributions (NI) of £1,106 are outstanding for the periods ending 5/4/2015 to 5/4/2017. Interest of £41 has also been incurred increasing the NI debt to £1,147. • At liquidation, the company had total liabilities of £112,974 and HMRC is the majority creditor. • At 19/12/2018 Mr Weaver owed the company, via his director’s loan account the sum of £86,453.
