Nigel Barton (“Mr Barton”) caused NJB Crane Operations Limited (“NJB”) to make false representations overstating the company’s turnover, in an application for a Bounce Back Loan (“BBL”) of £20,000, and failed to use the BBL funds for the economic benefit of NJB, in that: 1. Under the BBL scheme, businesses were entitled to borrow between £2,000 and £50,000 up to a maximum of 25% of turnover in the calendar year 2019. 2. On 24 November 2020, Mr Barton submitted a BBL application in which he stated that NJB’s turnover in the calendar year 2019 was £80,000. 3. NJB’s accounts for the year ended 31 July 2019 showed turnover of £9,480, an average of £790 per month. NJB’s bank statements show receipts into the account from customers between 01 August 2019 and 31 December 2019 of £35,900. 4. As a result of the overstatement of turnover in the BBL application, NJB borrowed at least £8,655 more than it was entitled to. 5. It was a requirement of the BBL scheme that the BBL funds were used for the economic benefit of NJB. 6. Between 06 December 2020 and 14 March 2021, Mr Barton paid the BBL funds of £20,000 to himself, £15,000 of which was after 06 December 2020, the date of the last payment into NJB’s bank account from a customer. No evidence has been provided that NJB received any economic benefit from paying the BBL funds to Mr Barton. 7. The Liquidator’s report to creditors states that the balance outstanding in respect of the BBL at the date of liquidation was £20,000.
