The Rule is made under the powers conferred by paragraph 1(1) of Schedule 2, and paragraph 21 of Schedule 7, to the European Union (Withdrawal) Act 2018 and is subject to the negative resolution procedure. The Christmas Bonus is an annual payment of £10 made to people entitled to a qualifying benefit in the first week of December. It is currently paid as set out in section 144 of the Social Security Contributions and Benefits (Northern Ireland) Act 1992 (the '1992 Act'). Prior to the end of the EU Exit transition period, the Christmas Bonus was payable to eligible people resident in the UK, the European Economic Area (EEA) or Switzerland. This Rule corrects a deficiency in existing legislation following EU Exit and the end of the transition period. It amends the 1992 Act in order to continue to make payments of the Christmas Bonus to eligible people resident in Switzerland. It also amends the 1992 Act to make clear that the Bonus is payable to eligible people in the EEA.
