NATIONAL HIGHWAYS LIMITED M25 MOTORWAY – JUNCTION 28 (NEAR BRENTWOOD) TEMPORARY TRAFFIC RESTRICTIONS Notice is hereby given that National Highways Limited intends to make an Order on the M25 Motorway in the County of Essex and the London Borough of Havering, under Section 14(1)(a), 14(7) and 15(2) of the Road Traffic Regulation Act 1984 because works are proposed to be executed on the road. The effect of the Order would be to: - 1. authorise the overnight and 24-hour closure, in phases, of: - (a) both carriageways of the M25 between Junction 27 (M11 Junction 6) and Junction 29 (A127); (b) both carriageway of the A12 from between the slip roads at Brook Street Interchange (M25 Junction 28); (c) all slip roads leading to and from the lengths of carriageway in 1. (a) above; (d) all slip roads leading to and from both lengths of carriageway at A12 Brook Street Interchange (M25 Junction 28); (e) the entire circulatory system of the roundabout at M25 Junction 28 (A12); (f) the A1023 local road at junction with the roundabout described in 1. (e) above; (g) the cycle track passing beneath the M25 between its junction with the western side of the slip road leading to the clockwise carriageway of the M25 and its junction with the southern side of the slip road leading to the London-bound carriageway of the A12; (h) the footway adjacent to the westbound carriageway of the A1023 local road, from a point approximately 45 metres west of the centreline of the A1023’s junction with Roman Road, to its junction with the eastern side of the slip road leading to the clockwise carriageway of the M25; and (i) the footway adjacent to the outside of the roundabout from its junction with the northern side of the slip road leading to the London- bound carriageway of the A12 and its junction with the southern side of the slip road leading from the eastbound carriageway of the A12. 2. impose a phased 24-hour 50mph or 60mph speed limit on: - (a) the clockwise carriageway of the M25 between the centreline of Horseman Side overbridge and the entry slip road at Junction 28 (A12); (b) the anti-clockwise carriageway of the M25 between the centreline of Warley Road overbridge and the centreline of Chequers Road overbridge; (c) the northeast-bound carriageway of the A12 between the exit slip at Brook Street Interchange (M25 Junction 28) and Wigley Bush Lane overbridge; and (d) the southwest-bound carriageway of the A12 between Weald Road overbridge and the tip of the nosing of the entry slip road at Brook Street Interchange (M25 Junction 28); (e) all slip roads leading to and from both lengths of carriageway at M25 Junction 28 (A12); and (f) all slip roads leading to and from both lengths of carriageway at A12 Brook Street Interchange (M25 Junction 28). 3. authorise the use of the hard shoulder adjacent to, and the outside lane by HGVs of: - (a) the anti-clockwise carriageway of the M25 between the centreline of the (eastern or western) underbridge at Junction 28 and a point 2000 metres northwest; and (b) the clockwise carriageway of the M25 between the centreline of Chequers Road overbridge to the centre line of the (eastern or western) A12 underbridge at Junction 28. 4. impose a width restriction of 2.75 metres in the outside lane, 3.0 metres in the middle lane and 3.25 metres on the inside or inside two lanes (where there are 4 lanes) on: - (a) the anti-clockwise carriageway of the M25 between the centreline of the (eastern or western) underbridge at Junction 28 and a point 2000 metres northwest; and (b) the clockwise carriageway of the M25 between the centreline of Chequers Road overbridge to the centre line of the (eastern or western) A12 underbridge at Junction 28. These measures would be in the interests of road safety while contractors undertake the creation of a new M25 to A12 exit loop, to include carriageway surfacing and marking, gantry, signage, signalling and electrical works, bridge works, drainage works, barrier, fencing and landscaping works, highway maintenance works, and all associated work. It is expected that the work would last for approximately 28 months starting on or after Tuesday 1st November 2022. The overnight closures would take place between the following hours (maximum period). Monday – Thursdays: 22:00 – 05:30 Fridays: 23:00 – 06:00 Saturdays: 22:00 – 06:00 Sundays: 22:30 – 05:30 The Order would come into force on 9th May 2022 and have a maximum duration of eighteen months, ceasing when the works are complete. Traffic affected by the remaining closures would be diverted using other junctions on the M25 and A12, and by using the M11, A406, A127, A128 and A1023. The diversion in operation would vary according to the closure in force. The temporary closures, speed limits, outside lane running, width restrictions, hard shoulder running and diversion routes would be clearly indicated by traffic signs when they are in operation during the works period. ENFORCEMENT 9. Upon the designation coming into force on 17 November 2022 any person having control of or who manages a licensable property without a licence, or allows a licensed property to be occupied by more households or persons other than as authorised by a licence, is liable to prosecution and upon summary conviction is liable to an unlimited fine pursuant to the provisions Section 95(1) of the Housing Act 2004. 10. A person who breaches a condition of a licence is liable to prosecution and upon summary conviction is liable to an unlimited fine. 11. The Council, as an alternative to initiating a prosecution, may pursue one or more of a range of other enforcement actions including the imposition of a financial penalty of up to £30,000 and/or taking management control of the unlicensed property. 12. Further, where an offence has been committed an application may also be made by the Council and/or tenant under the provisions of section 96 and 97 of the Housing Act 2004 for a Rent Repayment Order to pay back up to 12 months’ rent. 13. No notice under section 21 of the Housing Act 1988 may be given in relation to an assured shorthold tenancy of the whole or part of an unlicensed house so long as it remains an unlicensed house.
