Alexandra Francis failed to ensure that Sequential Dynamics Limited (“SDL”) met its financial obligations to HM Revenue & Customs (“HMRC”) and allowed SDL to trade to the detriment of HMRC from 22 August 2021 in respect of PAYE/NIC totalling £315,793. In that:PAYE/NIC• SDL’s last payment towards its PAYE/NIC liabilities was on 5 August 2021 for a total of£5,526.78, leaving a liability of £19,179.• SDL continued to submit PAYE/NIC returns from July 2021 to June 2022 disclosingliabilities totalling £296,614 leaving a total outstanding liability of £315,793.Comparative Treatment • A review of SDL’s bank accounts between 22 August 2021 and the date of liquidation on 12 September 2022 shows payments in, totalling Net £2,955,940 and payments out totallingNet £3,034,195. • Of the total payments paid out of the company bank accounts between 22 August 2021 and the date of liquidation on 12 September 2022 at least £1,384, 675 was paid to trade creditors and £11,000 paid/transferred to third parties. No payments were made to HMRC in relation to PAYE/NIC.
