Between 30 May 2017 and 30 April 2018, Caryl Hurford (Ms Hurford) failed to ensure Superior Style Home Improvements Limited (SSHIL) complied with its responsibilities under the Privacy and Electronic Communications Regulations 2003 (PECR); • An investigation was opened into SSHIL’s marketing practices by the ICO on 29 June 2018 following 83 complaints from individuals subscribed to the Telephone Preference Service (TPS); • The ICO investigation confirmed that between 30 May 2017 and 30 April 2018, 518,771 calls were made to subscribers of the TPS in breach of regulation 21 of the PECR. The calls represented 61% of all calls made during this period; • On 04 September 2019, having considered the various breaches of PECR regulation, the ICO issued a monetary penalty notice (MPN) against SSHIL in the sum of £150,000 within which it is stated that the Commissioner is satisfied that SSHIL failed to take reasonable steps to prevent the contravention; • The MPN was due for payment by 04 October 2019. No payments were made, and no appeal was received; • SSHIL entered compulsory liquidation on the 15 July 2020 after a petition was filed by the ICO on the 19 March 2020.
