On 23 July 2020 Benjamin Fletcher-Bates (“Mr Fletcher-Bates”) caused The Kabin Limited (“The Kabin”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on a BBL application resulting in The Kabin receiving more funds that it was entitled to from the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019 it is their estimated annual turnover from the date that the business was started. • The Kabin was incorporated on 31 October 2007 from when it commenced to trade. • On 23 July 2020 Mr Fletcher-Bates applied for a BBL of £50,000 on behalf of The Kabin declaring that The Kabin’s turnover for the calendar year 2019 was £270,000. The BBL agreement was signed by Mr Fletcher-Bates on 05 September 2020. • The Kabin’s bank statements from 01 January 2019 to 31 December 2019 record income to be £85,338. • Mr Fletcher-Bates stated The Kabin’s turnover of £270,000 which he declared on the BBL application was estimated based on potential future sales. • Based on recorded income of £85,338, The Kabin was entitled to receive a maximum BBL of £21,335. By overstating The Kabin’s turnover, it received £28,665 more than it was entitled to. • On 12 September 2020 The Kabin received the BBL funds of £50,000 into its bank account. • The Kabin entered Creditors Voluntary Liquidation on 21 August 2022. Total liabilities at liquidation amounted to £120,844, of which £50,000 related to the amount owed in respect of the BBL.
